Charitable Planning for The Mass Affluent

This session will focus on bunching and clumping in DAFs, using DAFs when an organization might lose its exempt status, QCDs, testamentary gifts being funded by retirement plans not bequests, and gifts of real estate.
Serving on Nonprofit Boards: Navigating Fiduciary Duties, Ethics, and Modes of Governance
Presenter: Kristin Walker Collins, J.D. CEO, Foundation for Appalachian Kentucky.
Attorneys are often invited to serve on nonprofit boards, but doing so requires a clear understanding of the ethical and fiduciary implications involved. This CLE session provides a practical overview of the key responsibilities attorneys must uphold when serving in this capacity, including the duty of care, loyalty, and obedience. Participants will also explore how to recognize and manage potential conflicts of interest and understand the legal boundaries of dual roles—as legal advisor and board member. In addition to these foundational obligations, the session introduces the Modes of Governance framework—Fiduciary, Strategic, and Generative—and how attorneys can engage meaningfully in each. By learning how and when to operate in these different governance modes, attorneys can contribute to nonprofit organizations in a way that is both legally compliant and mission-driven, enhancing board effectiveness while preserving professional integrity under Kentucky law and the Rules of Professional Conduct.
Issue Spotting and Counseling for Estate Planning Clients Worried About Current Events
